Terms of Service

These Terms of Service (“Terms”) are an agreement between SafeStats, LLC (“SafeStats”, “we”, “us”), an Arizona limited liability company, and you, covering your use of Esrala at esrala.com and the software and services it provides (the “Service”). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Who may use the Service

You must be at least 18 years old and able to enter into a contract to create an account. The Service is designed for a parent, legal guardian, or another adult responsible for a student’s education to operate on behalf of the students in their care.

Children do not have their own accounts. You create student profiles inside your account. You are responsible for everything that happens under your account, including activity by students using your family’s device, and for keeping your password and any parent passcode confidential. Tell us promptly at support@esrala.com if you believe your account has been used without your permission.

2. Parental consent for student profiles

Creating a student profile requires you to confirm that you are the child’s parent or legal guardian and that you consent to the collection and use of that child’s learning activity as described in our Privacy Policy. You may withdraw that consent at any time by deleting the student profile or your account, or by writing to privacy@esrala.com.

3. Your content and your rights

“Your Content” means the curriculum documents and files you upload, the profile details you enter, and the notes, answers, messages, and other material you or your students create in the Service. As between you and SafeStats, you own Your Content.

You grant us a limited, non-exclusive licence to host, copy, process, transmit, and display Your Content, and to create lessons and study material from it, solely to provide and support the Service for you. This licence exists so the software can function; it ends when you delete the content or your account, except for content still held in routine backups that have not yet expired.

We do not use Your Content to train artificial-intelligence models, and we do not sell it, publish it, or share it with other families.

4. What you promise about what you upload

You represent and warrant that, for everything you upload, you either own it or have the right to use it in the way the Service uses it — that is, to make copies and derivative study material for the private instruction of the students in your own household or care.

• Many publishers permit exactly this kind of personal, single-family educational use, and many restrict it. Reading your curriculum’s licence is your responsibility, not ours.
• Do not upload material you obtained unlawfully.
• Do not upload material you are contractually barred from copying, such as a licence limited to a single printed copy where digital reproduction is prohibited.
• Do not upload someone else’s personal information, or anything unlawful, harmful, or obscene.

We do not review uploads before they are processed. If we receive a valid notice that content infringes copyright, we may remove it and, for repeat infringement, terminate an account. Send notices to legal@esrala.com.

5. Acceptable use

You agree not to:

• Share your account with people outside your household or the students in your care, or resell access to the Service.
• Use the Service to generate material for anyone other than the students on your account.
• Attempt to bypass usage limits, rate limits, spending caps, or the parent passcode, or to reach another family’s data.
• Reverse engineer the Service, scrape it, or use automated means to extract its output in bulk.
• Use the Service to produce content that is unlawful, harassing, or harmful to a child.
• Interfere with the Service’s operation or security.

6. AI-generated material — an important limitation

Quiz scores are produced by automatic grading and are a rough signal, not a formal assessment. Nothing in the Service constitutes medical, psychological, legal, or professional advice.

You are responsible for meeting your own jurisdiction’s homeschool requirements, including instruction hours, subject coverage, assessment, and record keeping. Esrala does not determine whether your use satisfies those requirements.

7. Plans, billing, and cancellation

• Plans are billed monthly in advance, per student, at the price shown at checkout, in US dollars, plus any applicable tax.
• A paid subscription is required to generate lessons. An account without an active subscription for a student cannot generate new lessons for them; material already generated is not deleted.
• Card payments are processed by Stripe. We do not receive or store your full card number.
• You may cancel at any time from your account. Cancellation stops future billing and takes effect at the end of the period you have already paid for. We do not provide pro-rated refunds for partial periods except where the law requires it.
• We may change prices with at least 30 days’ notice to the email on your account. A price change never applies to a period you have already paid for.
• If a payment fails, we may suspend generation of new lessons until it is resolved.

Where you pay using an education savings account, scholarship, or similar program, you are responsible for confirming with that program that the purchase is an allowable expense. Program rules differ and change, and we cannot make that determination for you.

8. Usage limits

Each plan includes limits on student profiles, lessons generated per month, and stored lessons, as described on the pricing page. The Service also applies per-student and daily limits on AI usage to keep costs predictable. Reaching a limit pauses new generation; it does not delete anything you already have.

9. Our intellectual property

The Service itself — its software, design, interface, and the Esrala name and logo — belongs to SafeStats and its licensors. These Terms grant you a limited, revocable, non-transferable right to use the Service for your household’s own educational purposes, and nothing more.

10. Availability and changes

We aim to keep the Service running but do not promise uninterrupted availability. We may change, add, or remove features. If we discontinue the Service or materially reduce what your plan includes, we will give you reasonable notice and a chance to export your data, and we will refund any prepaid amount for the period you can no longer use.

11. Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate an account that breaches these Terms, creates a risk to us or to others, or is required to be terminated by law. Except where a serious breach or a legal obligation makes it impossible, we will give notice and a reasonable chance to export your data first.

12. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that AI-generated material will be accurate, complete, or suitable for any particular student.

13. Limitation of liability

To the fullest extent permitted by law, SafeStats will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or educational outcomes. Our total liability arising out of or relating to the Service or these Terms will not exceed the greater of one hundred US dollars ($100) or the amount you paid us in the twelve months before the event giving rise to the claim.

Some jurisdictions do not allow certain exclusions or limitations, so parts of the two sections above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

14. Indemnity

You agree to indemnify and hold SafeStats harmless from claims, damages, and reasonable expenses arising from Your Content, your breach of these Terms, or your violation of the rights of a third party — including a claim that material you uploaded infringed someone’s copyright.

15. Governing law and disputes

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of laws rules. You and SafeStats agree to try in good faith to resolve any dispute informally first by writing to legal@esrala.com. Any dispute that is not resolved informally will be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you and SafeStats consent to the jurisdiction of those courts. Nothing here prevents either party from seeking relief in a small-claims court.

16. Changes to these Terms

We may update these Terms. If a change is material, we will give notice by email or in the Service before it takes effect. Continuing to use the Service after that date means you accept the updated Terms. If you do not accept them, you may cancel.

17. General

• These Terms and the Privacy Policy are the entire agreement between you and SafeStats about the Service.
• If a provision is held unenforceable, the rest remains in effect.
• Our not enforcing a provision is not a waiver of it.
• You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
